MyJ-GLOBAL Service Terms of Use

J-GLOBAL is an information service managed by Japan Science and Technology Agency (“JST”). MyJ-GLOBAL service (“MyJ-GLOBAL”) works in conjunction with J-GLOBAL to provide registered users with customizations such as alert and clip functions. To use these functions, registration to MyJ-GLOBAL is required. In particular, some information such as the abstracts of medical literatures are available ONLY to the users who have registered MyJ-GLOBAL and entered necessary information.
The MyJ-GLOBAL Terms of Use (“the MyJ-GLOBAL Terms”) stipulates terms with which users are to comply when using J-GLOBAL and MyJ-GLOBAL. Also, the user may use any information provided via J-GLOBAL (“JST-provided information”) in accordance with, and within the scope of the MyJ-GLOBAL Terms. Please register for use only after you have carefully read the MyJ-GLOBAL Terms and agree to comply with them.
In addition to the MyJ-GLOBAL Terms, the user is to also comply with any terms of use that may exist for other sites and separately used services linked to J-GLOBAL.

1. Purpose of J-GLOBAL

JST operates J-GLOBAL for the purpose of “promotion of scientific and technological information distribution.” J-GLOBAL is widely available to the users to collect scientific and technological information.

2. Suspension, Interruption or Termination of J-GLOBAL

2-1. JST shall be able to apply constraints of the user access such Suspension, Interruption or Termination at any time for the Maintenance, Troubleshooting or any other reasons without prior notice. Also, JST may terminate the provision of all or a part of J-GLOBAL service at any time at the sole discretion of JST.
2-2. JST may take necessary measures including suspension of the use of J-GLOBAL in the event that (or JST suspects it is likely that) users are violating the terms.

3. User Registration

3-1. Those who wish to use MyJ-GLOBAL must first register on the J-GLOBAL registration site (“the site”) by providing an e-mail address and account information such as affiliated institution name (“the registered information”).
3-2. A person wishing to use MyJ-GLOBAL is considered to have consented to the MyJ-GLOBAL Terms at the point at which he or she registers an e-mail address.
3-3. When registering, the person wishing to use the MyJ-GLOBAL is to correctly enter his or her own information. Under no circumstances is it permitted to register in place of someone else or to enter information for anyone other than the person actually registering.
3-4. The user shall promptly update the registered information if there are any changes in the registered information after MyJ-GLOBAL registration.
3-5. JST may cancel a user registration for the use of the MyJ-GLOBAL without prior notification and as it deems necessary. JST may revoke permission for use and prohibit any reregistration by that user for the MyJ-GLOBAL use. In such a case, the user may not raise any objection to this cancellation of registration by JST nor to any refusal to permit reregistration.

4. Notes for Use of JST-provided information

The user shall not use JST-provided information, either in whole or in part, under any of the following items, unless granted permission by JST.
(1) Without regard to medium, JST-provided information may not be reproduced to publication (including that onto a CD-ROM or other electronic medium).
(2) JST-provided information may not be edited, processed, adapted, or otherwise revised.
(3) Whether or not free of charge and without regard to medium, JST-provided information may not be supplied, distributed, loaned, or transferred to others. Other restrictions include that it may not be publicly transmitted (a term that includes placing said information in a manner that enables automatic public transmission), redistributed, or permitted for others to use.
(4) JST-provided information is not to be stored on a server or other such device accessible to others.
(5) JST-provided information is not to be searched nor downloaded by automatic means or in heavy volume.
(6) JST-provided information may not be used nor supplied in any revenue producing manner.

5. Prohibitions

5-1. With regards to the use of J-GLOBAL or MyJ-GLOBAL by a user, JST prohibits any and all of the following actions.
(1) Infringement or suspected infringement of intellectual property rights, privacy, or other right of a third party by use of J-GLOBAL.
(2) Using J-GLOBAL in a manner or with a method that violates any law, cabinet order, regulation, ordinance, or other provision or the like established by either the national government or JST.
(3) Regardless of purpose, transfer, rent, permit others to use, or treat with any other manners, MyJ-GLOBAL or its license.
(4) Share the information associated with MyJ-GLOBAL in a machine-readable form.
(5) Actions with a possibility to potentially impair JST’s provision of J-GLOBAL and/or other services.
(6) Actions deviating from the purpose stated in “1. Purpose of J-GLOBAL.
(7) Actions giving inconvenience or disadvantage to the third party .by using J-GLOBAL or MyJ-GLOBAL.
(8) In addition to the preceding paragraph, any other actions deemed by JST to be inappropriate with regards to use of J-GLOBAL.
5-2. With regards to the use of JST-provided information by a user, JST prohibits any and all of the following actions.
(1) Actions that entails the use of JST-provided information to harm another party or cause distress, disadvantage or the like through slander or a sullying of that party’s honor or reputation.
(2) Removal, concealment or modification to any indication of patent rights, copyrights, trademark rights or other intellectual property rights displayed or contained within any JST-provided information.
5-3. If the user carries out such actions in “5-1” and “5-2”, JST may, without prior notification, eliminate that actions and take other measures as necessary.

6. Information to be Collected and its Usage

6-1. JST will acquire the access information (domain name, IP address, browser access date and time of accessed person, accessed date and time, page viewed, etc.) on the usage of J-GLOBAL, however such data will never identify individuals.
Also, although JST uses cookies, such information will never identify individuals as well. In order to improve our service, J-GLOBAL introduced Google Analytics for usage analysis. Data, such as the URLs of the visited pages, IP address or others, will be sent automatically from the user’s browsers to Google. In addition, Google will occasionally add or process Cookie. The user shall be deemed as the user have permitted google to process the data for above purposes and by such means.
6-2. The registered information, as well as alerts, clip articles, browsing history etc registered by the user through MyJ-GLOBAL (“the user information”) are collected and retained.
6-3. The collected access information will be used through statistical analysis for understanding the trend of usage of J-GLOBAL such as the trend of access in order to provide further effective services, as well as for monitoring excessive or unauthorized use and for recovering from system failures. We occasionally use Cookies for confirming the authentication information of users and so on. Also, the user information will be used through statistical analysis for understanding the trend of usage of J-GLOBAL such as the trend of access in order to provide further effective services. This collected information may be used for purposes of improving JST services other than J-GLOBAL, as well as statistical and academic research and analysis for science and technology policy making.
6-4. Your e-mail address registered for use of MyJ-GLOBAL will be used as a login ID for MyJ-GLOBAL, and also for sending alert services, function to contact researchers and notices from JST.
6-5. JST may disclose the collected information, to a necessary extent, to institutions (operation companies, etc.) which are involved in the operation of J-GLOBAL and JST services other than J-GLOBAL as far as the limited purpose of usage what specified in item “6-3” and “6-4”. Apart from the above, the collected information will not be used for any other purpose or be provided to third parties unless disclosure is required by law or due to some illegal acts such as unauthorized access or interference, etc. However, the collected information may be disclosed after being statistically processed.
6-6. JST will take necessary measures to prevent divulgation, loss or damage of the collected information and to appropriately manage such information.

7. Surveys and Questionnaires

JST expect users to cooperate with surveys, questionnaires, and other such projects advanced by JST in relation to J-GLOBAL.

8. Personal Information

Users are deemed to consent to the treatment of personal information in accordance with the following items:
(1) The personal information contained within the user registration information for the smooth and appropriate provision of J-GLOBAL and MyJ-GLOBAL in accordance with laws relating to the protection of personal information held by independent administrative agencies and in accordance with the JST privacy policy (http://www.jst.go.jp/EN/privacy.html) determined separately by JST.
(2) Upon taking protective measures, JST may entrust users’ personal information with external parties on managing and operating J-GLOBAL.

9. Intellectual Property Rights

9-1. Copyrights on JST-provided information remain with the providers of such information, including JST.
9-2. All rights pertaining to J-GLOBAL, including edit rights for its overall layout/design and copyrights for any related systems, are the property of JST and/or parties designated by JST.
9-3. Intellectual property rights and all other rights relating to JST-provided information and to J-GLOBAL are not, by the usage of J-GLOBAL, transferred to the users and third parties.

10. Disclaimers

10-1. JST is not liable for any damages, either direct or indirect, that may result from or be somehow related to the user’s use of J-GLOBAL.
10-2. JST provides no assurance of the veracity of JST-provided information, nor of its accuracy, credibility, or utility. Also, JST provides no assurance of the operational continuity/stability of its provision of J-GLOBAL.
10-3. Advertisers have the whole responsibility of the advertisements on J-GLOBAL. Users shall make use of the advertisements with their own discretion and responsibility.
10-4. JST is not liable for any damages incurred by the user or a third party within any of the following categories.
(1) Any damages produced by an interruption, stoppage or conclusion of J-GLOBAL provision.
(2) Any damages resulting from the contents of JST-provided information or a lack of revision to such information.
(3) Any damages resulting from a fault/failure of J-GLOBAL system.
(4) Any damages resulting from advertisements posted on J-GLOBAL and the use of another site linked from advertisements.
(5) Any damages arising from user registration for MyJ-GLOBAL.

11. Revisions to the MyJ-GLOBAL Terms

11-1. JST may revise the MyJ-GLOBAL Terms at any time and without prior notification. When the MyJ-GLOBAL Terms are revised, the revised Terms shall be posted on J-GLOBAL without delay and made public. When using J-GLOBAL after publication of the revised Terms, the user shall be deemed to have agreed to the revised Terms.
11-2. A use of MyJ-GLOBAL by a user following a revision of the MyJ-GLOBAL Terms is deemed as an acceptance of the revised Terms by that user.

12. Damages

If the user causes damage to a third party or JST by its act in violation of the MyJ-GLOBAL Terms, the user shall resolve it at their expense and responsibility. Also, any claim, dispute, or other such issue with a third-party that arises through the user’s use of J-GLOBAL or JST-provided information is to be handled and resolved between that user and the third-party, without involving JST in any manner.

13. Governing Law and Jurisdiction

The MyJ-GLOBAL Terms shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have primary exclusive jurisdiction with respect to any dispute between the user and JST regarding the use of MyJ-GLOBAL.

14. Language

The original of the MyJ-GLOBAL Terms of Use is Japanese version. This translated version is only for the convenience of non-Japanese users. In the event of a conflict between the Japanese version and the translated version, the Japanese version shall prevail.
