J-GLOBAL WebAPI Terms of Use

J-GLOBAL is an information service managed by Japan Science and Technology Agency (“JST”).
These J-GLOBAL WebAPI Terms of Use (“the Terms”) stipulates items to be observed by users (“the API user”) of an application-specific interface (“the API”) for J-GLOBAL provided by JST. Please register for use only after you have carefully read these Terms and agree to comply with them.

In addition to the Terms, the user is to also comply with J-GLOBAL Terms of Use and any terms of use that may exist for other sites and separately used services linked to the API.

1. User Registration

1-1. Those who wish to use the API must register first by providing an e-mail address, the account information such as affiliated institution name and an URL to be used for API (collectively referred to as “the registered information”). Upon internal approval, JST will issue an authentication key, which is necessary to complete this process.
1-2. A person wishing to use the API is considered to have consented to the Terms at the point at which he or she applies for using the API.
1-3. JST may refuse to accept an application for the API as JST deems inappropriate. Also, even after accepting an API user registration, JST may cancel that registration under these Terms and as JST deems inappropriate.
1-4. In such a case, the applicant for using the API or the API user is not to raise any objection to this rejection or cancellation of that user’s application for the API.
1-5. When applying, the person wishing to use the API is to correctly enter his or her own information. Under no circumstances it permitted to register in place of someone else or to enter information for anyone other than the person actually registering.
1-6. If, after applying for the API, there is any change in the registered information, the user is to promptly update the registered information.

2. Authentication key

2-1. JST deems that an API user has actually used the API at the point when JST, through some specific method of its own, has confirmed that an authentication key entered to use the API corresponds to that of the API user.
2-2. The API user is to be responsible for the management and control of the authentication key issued to that person. An authentication key, once issued, may not be transferred, loaned, or disclosed to a third party.
2-3. The API user is to bear responsibility for any damages resulting from mismanagement/miscontrol of the authentication key, misuses, use by a third party, etc. Also, JST must be promptly notified should it be determined that the authentication key is being improperly used by a third party.
2-4. JST is to bear no responsibility should an authentication key be improperly used and the API user or a third-party software incur damage.
2-5. If JST judges that the API user is not complying with the Terms, JST may, without prior notification, revoke that application for the API, discontinue that API license set forth in the Article 3-1 hereof, and prohibit any reapplication by that user for API use.
2-6. If an API user may not be confirmed to have used the API within some set period of time, JST may cancel that user’s API user registration and thereby discontinue that API license set forth in the Article 3-1 hereof.

3. License

3-1. JST, under the condition that the user is to fully observe these Terms and within the range of restrictions indicated at the time that the following right is granted, grants that user nonexclusive rights (“License”) to a partial use of data, codes, images, text, contents, tools, and other information (collectively referred to as “API-provided information”) contained on J-GLOBAL and accessed by the API within the range of restrictions indicated at the time that such right is granted.
3-2. API-provided information is not to be construed to mean that access is to be granted to all data managed on J-GLOBAL, including all data, codes, images, text, contents, tools, and other information provided by the API.
3-3. For any reason, JST may remove any License granted in the Article 3-1 at any time at its sole discretion without prior notification to API users.

4. Intellectual Property Rights

4-1. Copyrights on API-provided information remain with the providers of such information, including JST.
4-2. All rights pertaining to J-GLOBAL, including edit rights for its overall layout/design and copyrights for any related systems, are the property of JST and/or parties designated by JST.
4-3. Intellectual property rights and all other rights relating to API-provided information and to the website are not, by the usage of API, transferred to the users and third parties.
4-4. The API user is to display an indication that the effect that API-provided information displayed on or in the API user’s application has been provided by JST. The API user is also to provide a link to J-GLOBAL.

5. Notes for Use

5-1. Results obtained by an API user with this API (“Results using API”) may be posted on the website of that user.
5-2. The website that results using API is displayed must be available for use by end users free of charge. The API may not be used on any fee-based website.

6. Prohibitions

With regards to the use of the API, JST prohibits any and all of the following activities. If the user carries out such an activity, JST may, without prior notification, eliminate that activity and take measures set forth in the Article 2-5 hereof or other measures as necessary.
6-1. The API user may not use the API or API-provided information in a manner that slanders, sullies the honor or reputation, or otherwise harms JST or a third-party.
6-2. The API user may not remove, conceal or modify any indication of patent rights, copyrights, trademark rights or other intellectual property rights displayed or contained within any API-provided information.
6-3. The API user may not use the API or JST-provided information in a manner or with a method that violates a law, cabinet order, regulation, ordinance, or other provision or the like established by either the national government or JST (here after referred to as “laws, regulations, etc.”).
6-4. The API user is not to use the API or API-provided information beyond the scope clearly permitted under these Terms. Also, the API user is not to use any display that produces a false or misleading impression of any relation between JST and the API user nor use any method/manner that could cause a party viewing the application to confuse the application with J-GLOBAL. Furthermore, the API user is not to embed the API as the main contents of the API user.
6-5. Regardless of purpose, the API user is not to transfer, rent, permit for others to use, or otherwise dispose (treat) the API or the license. Also, the API is not to be used or supplied in any revenue-producing manner.
6-6. Regardless of purpose, the API user is not to transfer, rent, edit, process, adapt or otherwise revise, nor permit for others to use or otherwise dispose (treat) in whole or in part. Also, API-provided information is not to be used or supplied in any revenue-producing manner.
6-7. The API user may not store or cache API information on the API user’s server, etc., in a machine-readable form.
6-8. The API user is not to use the API or API-provided information on or within any application that contains the following contents.
(1) Grotesque or obscene expression; blatant sexual depiction/expression
(2) Violent expression; discriminatory expression citing a person’s race, gender, religion, nationality, physical limitations/incapacity, sexual orientation, age, etc.
(3) Expression that runs counter or is feared to run counter to public order and morals.
(4) Infringements upon the intellectual property rights, privacy rights, or image rights of JST or a third party.
(5) An untruth.
(6) A computer virus or other software, hardware, communication device or the like that obstructs, limits or damages proper operation or is feared to do so.
(7) Any other actions deemed by JST to be inappropriate.

7. JST’s Authority

7-1. Should JST deem necessary for assuring the quality and reliability of the links on or the API user’s application(s) , or should JST deem necessary for assuring observance with laws, regulations, etc. or with the Terms, or should JST deem necessary for assuring the rights, property, safety, etc., of JST, of a user of an API offering API-provided information, or of a third party , JST may monitor the API user’s application by crawling or other means and take other action as JST deems necessary.
7-2. Should it deem necessary for API operation, JST may revise its limits on API use by the API user (by, for example, limiting the frequency of user access to the API, access duration, access to the URL of the API, access to API-provided information, etc.) without prior notification.
7-3. JST may request that an API user stop posting any API-provided information provided by the API; and the API user, if so requested by JST, is to immediately take down said information.
7-4. So as to improve service by, for example, obtaining a better understanding of the access situation, creating rankings, and providing user support, JST is to maintain an access log (containing the domain name of the accessing party, together with its IP address, browser type, access date/time, etc.).

8. Surveys and Questionnaires

JST expect the API users to cooperate with surveys, questionnaires, and other such projects advanced by JST in relation to J-GLOBAL.

9. Suspension, Interruption or Termination of API provision

JST may terminate the provision of all or a part of API at any time for the Maintenance, Troubleshooting or any other reasons without prior notice.

10. Personal Information

API users are deemed to consent to the treatment of personal information in accordance with the following items:
(1) The personal information contained within the API user registration information for the smooth and appropriate provision of the API and API-provided information in accordance with laws relating to the protection of personal information held by independent administrative agencies and in accordance with the JST privacy policy (http://www.jst.go.jp/EN/privacy.html) determined separately by JST..
(2) Upon taking protective measures, JST may entrust API users’ personal information with external parties on managing and operating J-GLOBAL.

11. Disclaimers

11-1. JST accepts no responsibility within any of the following categories:
(1) The veracity of the API or of API-provided information, nor of its accuracy, credibility, or utility.
(2) The operational continuity/stability of the API or of API-provided information provision.
11-2. JST accepts no responsibility whatsoever for damages, claims or the like resulting from a use of the API within any of the following categories:
(1) Any damages produced by an interruption, stoppage or conclusion of API provision.
(2) Any damages resulting from the contents of API-provided information or a lack of revision to such information.
(3) Any damages arising from use of the API or from API user registration.

(4) Any damages resulting from the use of an authentication key by a party other than the API user as a result of a theft of said key, a misuse, or some other reason.

12. Revisions to the Terms

JST may revise the Terms at any time and without prior notification. When the Terms are revised, the revised Terms shall be posted on J-GLOBAL without delay and made public. When using J-GLOBAL after publication of the revised Terms, the user shall be deemed to have agreed to the revised Terms.

13. Damages

If the API user causes damage to a third party or JST by its act in violation of the Terms, the user shall reimburse the damage at their expense and responsibility. Also, any claim, dispute, or other such issue with a third-party that arises through the API user’s use of the API is to be handled and resolved between that API user and the third-party, without involving JST in any manner.

14. Governing Law and Jurisdiction

The Terms shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have primary exclusive jurisdiction with respect to any dispute between the API user and JST regarding the use of the API.

15. Language

The original of the J-GLOBAL WebAPI Terms of Use is Japanese version. This translated version is only for the convenience of non-Japanese users. In the event of a conflict between the Japanese version and the translated version, the Japanese version shall prevail.
